Image Consent
This page explains how we ask for permission before using photographs of your smile, and what that permission covers. It exists because your face is yours: a photograph of your teeth is personal information, and under Colombian law it is treated as sensitive data.
The short version
- Publishing your photographs is entirely optional. Saying no has no effect on your treatment, your price or your care.
- If you say yes, you choose whether your name appears, where the photographs may be used, and for how long.
- You can change your mind at any time and we will remove them.
- We never edit a photograph to make a result look better than it is.
1. What we ask permission for
Before and after treatment we take clinical photographs. They are part of your clinical record and are used to plan and document your treatment — for that use no separate permission is needed beyond the assessment you already authorised, and they are never published.
Separately, we may ask whether we can use some of those photographs publicly, for example in the before-and-after gallery on this website, on our Instagram account, or in advertising. That is a different question, a different document, and entirely your choice.
2. What the public permission covers
If you sign it, the consent form will specify, for your case:
| Which photographs | The specific images, listed or attached, in the same angle and framing |
|---|---|
| Where they may appear | You tick each one you agree to: this website · Instagram · Facebook · paid advertising on Meta platforms · printed material in the clinic |
| How you are identified | You choose: no name at all (“patient of Luxe Smile”) · initials only · first name and city · full name |
| How long | You choose: 1 year · 3 years · 5 years · until you withdraw it |
| Any text alongside | Only factual description: number of units, treatment performed, number of visits, and the date or month |
3. How the photographs will be used honestly
If you consent, we commit to all of the following:
- We will not retouch your teeth to change the result. No whitening, no reshaping, no removing or adding teeth. Permitted adjustments are limited to cropping, straightening the frame, and correcting exposure or colour balance so the photograph looks as it did in the room.
- The before and after will be comparable: the same angle, the same lighting, the same framing, and taken in the same session wherever possible.
- We will not present your case as typical. Wherever before-and-after photographs appear, we state that individual results vary.
- We will not make claims about you that are not true — for example that you are a customer of a product you never used.
- We will not use your photographs in a way that suggests you endorse something you have not agreed to endorse.
- Where we use them in paid advertising on a platform such as Meta (Facebook and Instagram), we will follow that platform's advertising policies, including its rules on health and cosmetic imagery.
- We will not sell or license your photographs to anyone else.
4. If you would rather not
That is completely fine, and it is the more common answer. We will still treat you, at the same price, in the same way. You do not have to give a reason, and we will not ask again.
If you decline, your photographs stay in your clinical record, accessible only to the team treating you, and are deleted according to our Privacy Policy.
5. How to withdraw a permission you already gave
- Email luxesmileveneers@gmail.com with the subject "Withdraw image consent", or message us on WhatsApp at +1 (727) 423-4213.
- You do not need to give a reason.
- We will remove the photographs from the channels you listed, and stop using them in anything new, within 30 days.
- We will confirm in writing when it has been done.
Two practical limits, stated honestly: we cannot remove a printed brochure that has already been produced and is in circulation, and we cannot remove copies that other people have shared or that search engines have cached. We will do everything within our control, and we will tell you what we did.
6. What happens if you are under 18
We do not publish photographs of anyone under 18 without the written consent of a parent or legal guardian, and we do not treat or photograph minors through this website at all.
7. How the consent is recorded
The permission is signed on a separate form, on paper or digitally, with a date. We keep it for as long as we use the photographs, because we have to be able to demonstrate that you agreed. It is separate from the consent checkbox on the consultation form, which only covers using your photographs to assess your case.
If you are reading this page as part of our advertising review process: this document describes the consent process; the signed form is the record, and it does not form part of the website's public content.
